Daily Basket: BigBasket a bully for sending legal notice over the use of the word ‘basket’

India-based online grocery firm BigBasket has sent a legal notice to South India-based startup Daily Basket over the use of the word “basket” in its brand name.

In the notice, BigBasket demanded that Daily Basket shut down its operations immediately and hand over its domain name free of cost. The company has also asked the Coimbatore-based startup to pay BigBasket’s legal team 200,000 rupees (US$2,761) in compensation to cover the cost of the legal notice.

Launched in August 2020, Daily Basket aims to set up a string of mini supermarkets in Coimbatore to act as delivery hubs for its online delivery business. Currently, the company operates one warehouse and is on track to open a mini-store on February 25.

BigBasket did not respond to Tech in Asia‘s query regarding the legal notice.

BigBasket’s claims mention that Daily Basket has tried to imitate the former’s domain name, website, and mobile application. The grocery major then accused Daily Basket of “trying to create an impression that it is associated with BigBasket for Coimbatore.”

In response, Daily Basket has created a website with the domain name “BBisabully.com,” which states in bold letters that “BigBasket is bullying dailybasket.com with [a] cease and desist letter.” It further goes on to explain the startup’s point of view and its counterarguments against BigBasket’s claims.

“We never misuse BigBasket’s brand in any way as they claimed in the cease and desist letter. That’s a blatant lie. This is our attempt to debunk their claims,” Daily Basket stated on the website, where it also provides a copy of the legal notice.

Its counterarguments include screenshots of both companies’ brand names, logos, websites, mobile apps, and Google Play store details.
