Indian court fines Amazon $38.9m for trademark violation
The Delhi High Court has ordered Amazon to pay 339.3 crore rupee (US$38.89 million) to Lifestyle Equities for trademark infringement related to the Beverly Hills Polo Club (BHPC) logo.
The ruling includes 292.7 crore rupee (US$33.55 million) for lost royalties, 43.33 crore rupee (US$4.97 million) for increased advertising costs, and 3.23 crore rupee (US$370,190) in additional fees.
Lifestyle Equities argued that Amazon’s private label, Symbol, sold products with a similar logo, causing consumer confusion and diluting BHPC’s goodwill.
Previously, the High Court issued an injunction instructing Amazon and Cloudtail India to remove the infringing products within 72 hours.
The ruling follows a related UK Supreme Court decision in March 2024, which also favored Lifestyle Equities in a similar case.
This case highlights Amazon’s ongoing legal challenges in India, including scrutiny by the Competition Commission of India (CCI) over alleged anti-competitive practices.
Despite these issues, the company continues expanding in the Indian market.
