A United States federal judge has dismissed Google’s motion to end a class-action lawsuit alleging the company collected users’ personal data after they disabled tracking settings.

Chief Judge Richard Seeborg of the Northern District of California has scheduled the trial for August 18.

The plaintiffs argue that Google violated California’s anti-fraudulent computer access law by collecting browsing data without consent, despite users turning off the “Web & App Activity” feature.

They contend that Google’s disclosures about this setting were misleading.

Google has not commented on the latest ruling.
