US CFTC eyes spot crypto trading launch next month

Caroline Pham, acting chair of the US Commodity Futures Trading Commission (CFTC), said she is in talks with regulated exchanges to launch spot cryptocurrency trading, including leveraged products, possibly as soon as next month.

These discussions involve CFTC-regulated designated contract markets such as CME, Cboe Futures Exchange, ICE Futures, Coinbase Derivatives, Kalshi, and Polymarket US.

Pham confirmed the talks in a post on X, referencing a recent CoinDesk report.

The move uses existing CFTC authority requiring retail commodity trading with leverage or margin to be conducted on regulated platforms.

This development comes amid a government shutdown, which has delayed the Senate confirmation of Mike Selig, nominated by former President Trump to replace Pham.

The CFTC and SEC issued guidance in September clarifying that registered exchanges are not prohibited from facilitating trading of certain spot commodity products, including digital assets.

🧠 Food for thought

Implications, context, and why it matters.

Which assets qualify for spot crypto listings

  • The September U.S. Securities and Exchange Commission (SEC)–Commodity Futures Trading Commission (CFTC) joint statement allows exchanges to list spot crypto products 1. Uncertainty remains over which tokens fit the CFTC commodity category versus the SEC securities category.
  • The staff cited “certain spot crypto commodity products” 2. Bitcoin and Ether are often treated as commodities 2. Newer tokens face tougher questions.
  • CFTC retail commodity transaction rules under 7 U.S.C. 2(c)(2)(D) require leveraged or margined retail spot trades to occur on registered venues 3. Without an eligibility list, venues may start with established names to limit enforcement risk.
  • Chicago Mercantile Exchange (CME) lists Bitcoin and Ether futures 4, so it could add spot first. Margin rules and investor protection standards could curb retail access in the U.S. relative to offshore platforms.

Futures commission merchants may become gatekeepers for institutional spot crypto access

  • If CFTC-registered designated contract markets (DCMs) list spot crypto, futures commission merchants (FCMs) can sit between the venue and institutions.
  • FCMs backing CME crypto futures already run Know Your Customer (KYC) and Anti-Money Laundering (AML) controls. CME volumes hit a record 340,000 contracts per day in Q3 2025 5.
  • Vendors serving FCMs and clearing firms (which handle trade settlement) need stronger margin engines and real-time links. Educational tools will support spot flows with derivatives.
  • Consumer apps and other retail platforms will race to offer compliant access. CME plans 24/7 trading, while clearing and settlement post the next business day 6.
