US-based social media startup aims to use ‘Twitter’ brand

Operation Bluebird, a social media startup based in Virginia, has asked the US Patent and Trademark Office to cancel Twitter trademarks held by Elon Musk’s X Corp, claiming the marks have been abandoned.

The company wants to use the names “Twitter” and “tweet” for its own rival platform, “twitter.new,” and has separately filed to trademark “Twitter.”

Stephen Coates, Operation Bluebird’s general counsel and a former trademark lawyer at Twitter, submitted the petition on December 2.

Musk acquired Twitter for US$44 billion in 2022 and later rebranded it to X, removing references to the Twitter brand across products and ad.

🧠 Food for thought

Implications, context, and why it matters.

US Patent and Trademark Office (USPTO) records can indicate if X Corp still claims active use of Twitter marks

  • Petition prospects partly depend on whether X Corp filed proof of continued use through USPTO maintenance filings such as Section 8 declarations of use or excusable nonuse (a post-registration filing stating a mark is still used or explaining temporary nonuse) and Section 9 renewals (the periodic renewal filing) 1. TSDR, the USPTO’s public record database, lists these filings and statuses 2.
  • X Corp’s 2023 renewal was approved, but approval does not guarantee protection if actual commercial use (use in the marketplace for goods or services) stopped after filing. TSDR lists assignment information (ownership changes) and post-registration documents 3.
  • Operation Bluebird’s general counsel, a former Twitter trademark lawyer, would likely know which TSDR records best support an abandonment argument.

Marketers can capture residual “Twitter” search intent if behavior lags the rebranding

  • If Google Trends (Google’s public search-interest tool) data stays steady for “Twitter” versus “X”, SEO teams can bid on “Twitter” keywords to reach users who use the old name. Year-over-year analysis can reveal whether adoption of “X” is rising or stalling, which guides timing and budget.
  • Marketing technology vendors could build tools like current Google Trends integrations 4 that track brand transition gaps in real time, then alert clients when competitor rebrands open keyword arbitrage chances.
  • Consumer brands in sectors where Twitter or X has strong ties can watch Pinterest Trends 5 (Pinterest’s public trend-spotting tool). They can time campaigns around spikes in “Twitter” nostalgia searches if sentiment data shows user dissatisfaction with X’s direction.
