Trump signs bill criminalizing revenge porn, deepfakes
President Donald Trump is set to sign the Take It Down Act into law on May 20, 2025.
This bipartisan bill creates tougher penalties for sharing non-consensual explicit images, including deepfakes and revenge porn.
The law makes it illegal to publish these images, whether real or AI-generated, with offenders facing fines, jail time, and restitution.
Online platforms must remove flagged content within 48 hours and block copies from spreading.
Although many states already have similar laws, this is the first federal regulation tackling non-consensual explicit images.
Senators Ted Cruz and Amy Klobuchar sponsored the bill, motivated by a case involving a delayed removal of an AI deepfake of a minor.
The new law aims to protect victims while holding offenders and platforms accountable, marking a key step in addressing online abuse with federal authority.

🧠 Food for thought
1️⃣ The evolution from patchwork state laws to federal regulation
The Take It Down Act represents the culmination of a seven-year legal evolution that began at the state level.
Virginia became one of the first states to specifically address AI-generated deepfakes in 2019 by amending its existing revenge porn laws to include “falsely created” explicit material 1.
By 2023, 34 states and the District of Columbia had enacted some form of non-consensual pornography legislation, creating a patchwork of protections with varying definitions and penalties 2.
This inconsistent legal landscape left many victims without recourse when images crossed state lines, highlighting the jurisdictional challenges that necessitated federal intervention 3.
The federal approach now provides uniform protection regardless of location, addressing a fundamental weakness in state-by-state regulation that made enforcement particularly difficult in the borderless digital realm.
2️⃣ A gendered problem requiring specialized legal frameworks
