Trump administration defends Anthropic blacklisting in US court

In a court filing on March 17, the Trump administration said the Pentagon’s blacklisting of Anthropic was lawful and justified, pushing back against the company’s lawsuit.

Anthropic, a US AI startup behind the Claude assistant, was designated a national security supply chain risk by Defense Secretary Pete Hegseth on March 3.

The move followed the company’s refusal to remove guardrails on the use of its models for autonomous weapons or domestic surveillance.

In a Justice Department filing, the administration said Anthropic is unlikely to prevail on First Amendment claims and framed the dispute as one over contract negotiations and national security rather than retaliation.

The filing said Anthropic’s refusal to remove restrictions on the use of its products was conduct, not protected as speech, and that no one had purported to restrict Anthropic’s expressive activity.

Anthropic has sued in federal court in California seeking an injunction and is separately challenging a supply chain designation in a Washington, D.C. appeals court.

🧠 Food for thought

Implications, context, and why it matters.

Trump’s directive and Hegseth’s announcement set up the designation

  • After a Truth Social post from President Trump, federal agencies were told to stop using Anthropic’s technology 1.
  • Soon after that, Defense Secretary Pete Hegseth wrote on X (formerly Twitter) that Anthropic would be labeled a supply chain risk 2.
  • The supply chain risk label has usually targeted foreign adversaries such as Chinese firm Huawei, not US companies 3.
  • Hours later, rival OpenAI said it had landed a new deal to run its AI models on the Pentagon’s classified networks 1.

Effects of the blacklisting spread past government work

  • Anthropic said the blacklisting could cut 2026 revenue by “multiple billions of dollars” 3.
  • More than 100 enterprise customers contacted the company with questions, and talks with financial firms totaling $180 million were thrown off track 3.
  • One analyst warned the move could scare other tech companies away from Pentagon projects, since it signals the US government will “grab your ankle and pull you all the way in” 4.
  • Researchers and engineers from competitors OpenAI and Google backed Anthropic in a court brief, saying the government’s step could narrow debate on AI safety 5.
