Ireland’s Data Protection Commission said on June 30 it would decide whether to seek new sanctions against TikTok after the Irish High Court told it to reconsider an order to suspend transfers of European Union user data to China.

TikTok, the short-video platform owned by China-based ByteDance, is regulated in the European Union by Ireland’s DPC.

In its May 2025 decision, the DPC said its inquiry covered European Economic Area user data accessed remotely from China by ByteDance personnel.

It found breaches of GDPR Article 46(1) on transfers and Article 13(1)(f) on transparency, and fined TikTok 485 million euros (US$553 million) and 45 million euros (US$51.4 million).

The regulator also ordered TikTok to bring its processing into compliance within six months after the appeal period, and to suspend the transfers if it did not.

The High Court later stayed that order pending appeal.

TikTok said remote-access transfers were continuing during the stay and that Project Clover includes a 12 billion euros (US$13.7 billion) investment in European data security.

The DPC said TikTok had not shown its safeguards gave data protection essentially equivalent to European Union standards.
