Taiwan cracks down on alleged Nvidia server smuggling

Taiwan prosecutors are seeking to detain three people accused of using forged documents to ship Nvidia AI servers to China.

The servers were made by US server maker Super Micro.

The Keelung District Prosecutors Office said on May 21 that the suspects knew the servers were tightly controlled and conspired to buy them in Taiwan and export them with false declarations.

The case is Taiwan’s first public crackdown on alleged AI chip smuggling.

Similar cases in the US and Singapore involving servers from Super Micro, Dell, and HPE, though authorities have not accused the server makers of wrongdoing.

🧠 Food for thought

Implications, context, and why it matters.

This small bust is separate from a multibillion-dollar US smuggling case

  • Prosecutors said the Taiwan case covers about 50 servers. They said it started on its own and has no direct link to the US probe into an alleged US$2.5 billion server diversion scheme involving Super Micro 1.
  • In the US case, prosecutors allege Super Micro co-founder Yih-Shyan “Wally” Liaw helped run a plan that used a Southeast Asia-based intermediary company to divert servers to China 2.
  • Prosecutors allege the operation used thousands of non-working dummy servers during inspections to hide that the real machines had already shipped 2.
  • They also allege the group used a hair dryer to remove and reattach labels and serial number stickers on dummy servers and boxes to mislead inspectors 2.

Taiwan is using local fraud laws, like Singapore did, though broader claims are not supported here

  • Taiwan is using local offenses such as forgery and fraud to pursue alleged export-control evasion. The move comes after years of US pressure on Taiwan to act more forcefully on export-control violations 1.
  • Singapore took a similar path in 2025, when it arrested three men accused of misleading server suppliers about the final destination of hardware first sent to Malaysia 1.
  • These cases show that shipping and transshipment hubs are turning to local criminal laws to pursue alleged export-control evasion routes. The sources do not establish a coordinated enforcement effort 1.
  • Separately, the sources in this draft mention Nvidia’s guidance, which assumes no data center computing revenue from China going forward 3.
