South Korea to implement AI law in January 2026
South Korea will implement a new AI regulatory framework on January 22, 2026, making it the first country to enforce comprehensive AI rules.
The AI framework act includes the formation of a national AI committee, a three-year plan, and mandates on safety, transparency, and disclosure for certain AI systems.
The enforcement decree is expected to be finalized shortly before the law takes effect, raising concerns among industry groups that companies, especially startups, may not have enough time to prepare.
A survey by Startup Alliance found that 98% of 101 local AI startups do not have systems in place to comply with the new rules, with nearly half unfamiliar with the law.
Some industry insiders said strict regulations could push companies to launch services abroad, and pointed to Japan’s more voluntary regulatory approach as an alternative.
Mandatory watermarking for AI-generated content is a particular concern among content companies, who say the requirements are unclear and could impact consumer perception.

Its draft Enforcement Decree permits human- or machine-readable tags, including invisible watermarks. Compliance service providers can serve an unprepared Korean AI market with specialized offerings
