Rivian sues US to recover Trump-era tariffs

Rivian, a California-based electric vehicle maker, sued the US government in the US Court of International Trade on July 23 to recover tariffs it paid under Trump-era measures that the Supreme Court later struck down.

The complaint names the US government, US Customs and Border Protection (CBP), and CBP Commissioner Rodney Scott.

Rivian is seeking a full refund with interest, court fees, and a ruling that the tariffs were unlawful.

The case concerns tariffs imposed under the International Emergency Economic Powers Act (IEEPA), which the Supreme Court said on Feb. 20, 2026, that Trump lacked authority to impose.

Rivian CFO Claire McDonough said in April that the company expected refunds in the tens of millions of dollars.

The filing says importers are not guaranteed repayment because refunds are not automatic, require filing through a CBP process, and may remain uncertain for some finally liquidated entries.

Rivian’s suit comes as the Justice Department is appealing a trade judge’s attempt to order broad refunds, while other companies have sued over the same IEEPA tariffs.
