Pentagon sued by Chinese chipmaker CXMT over military listing

ChangXin Memory Technologies, China’s top maker of dynamic random-access memory chips, sued the Pentagon on August 28 to overturn its inclusion on a US Defense Department list of companies Washington says aid Beijing’s military.

CXMT said in its lawsuit that it is not affiliated with the Chinese military and that it designs, produces, and sells its DRAM chips for civilian and commercial use.

The company argued the designation could trigger US government contracting restrictions and cause reputational damage.

The list is published under Section 1260H of the National Defense Authorization Act and is distinct from the Commerce Department’s Entity List, though inclusion can raise legal, compliance, and reputational risks.

Washington was also considering adding CXMT to the Commerce Department’s Entity List in 2025, indicating that the Pentagon designation may not be the company’s only source of US pressure.
