Palantir sues rival CEO over employee poaching

Palantir has expanded its lawsuit against two former employees to include Percepta AI CEO Hirsh Jain, alleging violations of non-solicitation agreements.

The US-based analytics software firm claims Jain, co-founder Radha Jain, and Joanna Cohen tried to recruit Palantir staff and misuse confidential information after leaving to join Percepta, an AI startup founded by Hirsh and Radha Jain.

The suit says Percepta has hired at least 10 former Palantir employees and cites messages about plans to recruit more.

Percepta denied using Palantir’s confidential information and called the lawsuit baseless.

Cohen and Radha Jain, named in an earlier complaint, agreed to stop working at Percepta during legal proceedings.

Palantir seeks to prevent the defendants from working at Percepta or General Catalyst for 12 months and wants any company information returned.

🧠 Food for thought

Implications, context, and why it matters.

New York’s pending non-compete ban could weaken Palantir’s case against Percepta

  • The case sits in New York federal court. A bill the State Senate passed in June 2025 would bar most non-competes if enacted 1.
  • Workers covered by the bill can sue over violations. Courts could void deals and award up to $10,000 per person 2.
  • The bill would not cancel existing agreements 3. It still injects uncertainty for enforcement since Palantir seeks a 12-month work restriction. The proposal permits a non-compete up to one year with pay during enforcement 1.
  • Governor Kathy Hochul has not taken a public position. This narrower bill answers her 2023 veto by adding carve-outs for high earners and business sales 1.

Litigation risk around Palantir-alumni startups creates openings for “clean hiring” compliance vendors (tools, plus processes to prevent misuse of confidential information, plus improper recruiting)

  • Percepta has hired at least 10 former Palantir employees 4. Palantir alumni have launched startups that raised over $6 billion, including Anduril, a defense technology company, at $3.8 billion 4.
  • Vendors offering trade secret hygiene audits, non-solicitation compliance software, or employee transition protocols can focus on defense tech and AI startups from Palantir alumni 54. Examples include Pryzm, Distyl AI, and Peregrine. Pryzm raised $12.2 million from Andreessen Horowitz (a16z) 5. Peregrine raised $252.7 million 4.
  • Early-stage defense and AI investors can stand out by giving portfolio companies access to specialized employment counsel or human resources (HR) compliance frameworks that cut litigation risk from established rivals like Palantir.
