OpenAI seeks dismissal of Apple trade secrets lawsuit

OpenAI has asked a federal judge in the Northern District of California to dismiss Apple’s July lawsuit accusing the ChatGPT maker of stealing trade secrets by recruiting Apple employees. The company called the claims meritless in a court filing.

OpenAI said chief hardware officer Tang Tan followed standard recruiting practices.

It also said former Apple engineer Chang Liu was helping former Apple colleagues find work files, rather than taking confidential information for OpenAI.

Apple alleges OpenAI used job candidates and new hires to obtain hardware-related trade secrets. Apple also claims Liu accessed internal files through an authentication bug for several weeks after joining OpenAI in January.

On August 5, Apple asked for a preliminary injunction to block OpenAI from using the alleged trade secrets and to require the return of any confidential material while the case proceeds.

OpenAI must respond by August 17, and a hearing is scheduled for October 1.
