OpenAI and Statsig will pay US$3.2 million under a settlement announced on Aug. 4 over claims by the US Justice Department that they favored foreign workers with temporary employment visas over US workers in recruiting and hiring.

The department said OpenAI and Statsig, a US-based product development software company, violated the Immigration and Nationality Act by requiring some US applicants to mail paper applications instead of applying electronically, and by not posting certain jobs on an external website.

The Justice Department also alleged that the companies advertised some roles on the radio late at night. It said the case involved fewer than 10 positions.

The settlement includes US$1.2 million in penalties and US$2 million to compensate alleged victims of discrimination. It also requires policy changes, training, and Justice Department monitoring.

OpenAI denied wrongdoing in the settlement agreement.
