OpenAI files countersuit against Musk

OpenAI has filed a countersuit against Elon Musk, alleging harassment and seeking to prevent further actions against the company.

In the countersuit, OpenAI claims Musk has used his social media platform and legal strategies to harm the company. It describes his actions as “harassing legal claims.”

The company is requesting the court to hold Musk accountable for damages and to prevent further interference.

The filing was submitted in the US District Court for the Northern District of California on Apr. 9, 2025. It claims that Musk has engaged in unfair practices during an ongoing legal battle over OpenAI’s transition to a for-profit model.

Musk, who co-founded OpenAI in 2015 with CEO Sam Altman but left before the company’s growth, has opposed the planned structural shift.

OpenAI argues that this transition is necessary to secure US$40 billion in funding by the end of this year.

Musk launched his own AI firm, xAI, in 2023 and has criticized OpenAI’s shift away from its original mission of prioritizing humanity over profit.
