Musk’s xAI sues Apple, OpenAI over AI competition

Elon Musk’s companies X and xAI have filed a lawsuit against Apple and OpenAI, accusing them of working together to limit competition in the AI sector.

The complaint claims that Apple’s partnership with OpenAI, which will bring ChatGPT to Apple devices, is aimed at protecting Apple’s position in the smartphone market.

Apple first announced its collaboration with OpenAI in June, and devices with integrated ChatGPT are expected to launch in December.

Musk, who helped start OpenAI and later criticized its shift to a for-profit model, posted on X that “it’s impossible for any AI company besides OpenAI to reach #1 in the App Store.”

The lawsuit marks the latest escalation in ongoing disputes between Musk and OpenAI CEO Sam Altman.

🧠 Food for thought

1️⃣ Musk’s OpenAI conflict has deep roots dating back six years

This lawsuit represents the latest escalation in a conflict that began when Musk left OpenAI’s board in February 2018, citing potential conflicts with Tesla’s AI development for autonomous driving1.

At that time, Musk resigned specifically to avoid conflicts of interest as Tesla increasingly focused on AI technologies, though he continued as a donor and advisor to the organization he co-founded2.

The timing reveals how personal disputes can evolve into major corporate legal battles. What started as a business separation in 2018 has now become a full antitrust lawsuit alleging monopolistic practices3.

Musk’s departure from OpenAI occurred during a period when he was already warning about AI as humanity’s “biggest existential threat,” making his current position as an AI company owner through xAI particularly notable1.

2️⃣ Strategic partnerships are reshaping competitive dynamics in AI

Apple’s partnership with OpenAI, announced in June 2024, demonstrates how established tech giants are leveraging external AI capabilities rather than building everything internally4.

The lawsuit specifically targets this partnership model, claiming that Apple’s integration of ChatGPT into iPhones creates unfair advantages by prioritizing OpenAI’s technology in the App Store over competitors5.

This reflects a broader industry shift where companies like Apple are acknowledging their AI gaps and forming strategic alliances. Analysts have characterized Apple’s OpenAI partnership as a significant move to strengthen its AI ecosystem6.
