Musk denies sabotaging OpenAI for his AI startup

Elon Musk has rejected claims from OpenAI that he launched a year-long campaign to undermine the company.

In a court filing on May 7, his lawyer, Marc Toberoff, asked the court to dismiss allegations that Musk used lawsuits, social media, and public statements to harm OpenAI in favor of his own AI startup, xAI.

The dispute stems from OpenAI’s decision to restructure its for-profit arm into a public benefit corporation.

Musk, who left OpenAI’s board in 2018, filed a lawsuit last year claiming the company strayed from its nonprofit mission. OpenAI responded with a countersuit in April, accusing Musk of trying to damage its business and investor ties.

🧠 Food for thought

1️⃣ The evolution from non-profit idealism to commercial reality in AI

OpenAI’s journey shows how difficult it is to maintain purely altruistic structures while competing in capital-intensive AI development.

The organization was explicitly founded in 2015 as a non-profit to ensure AI would benefit humanity without being constrained by financial returns, with Musk and others committing $1 billion initially 1.

This idealistic foundation has been challenged by practical realities, as evidenced by OpenAI accepting a $1 billion investment from Microsoft in 2019, which began its transition to a hybrid structure that could accommodate commercial interests while theoretically maintaining its mission 2.

The recent decision to maintain nonprofit control while still creating a public benefit corporation structure demonstrates the persistent tension between mission and market pressures, with both Musk and others arguing that any shift toward profit orientation betrays OpenAI’s founding purpose 3.

This challenge is not unique to OpenAI, as the broader AI industry also struggles to balance ethical commitments with the massive computing resources needed for cutting-edge research.

2️⃣ From co-founder to adversary: How shared concerns led to divergent paths

The Musk-OpenAI conflict illustrates how founders with shared values can develop fundamentally different approaches to the same problem.

Musk co-founded OpenAI motivated by serious concerns about AI safety, describing artificial intelligence as potentially “our biggest existential threat” in 2014 and likening advanced AI development to “summoning the demon” without proper oversight 4.

These safety concerns first united Musk with OpenAI’s other founders in creating an organization specifically designed to counter dangerous AI development, but these same concerns now fuel his legal and public criticism of the organization 4.
