Indonesia expands ecommerce rules to ride-hailing, OTAs

Indonesia’s trade minister, Budi Santoso, signed a revised ecommerce regulation on June 4.

The rules replace Trade Minister Regulation No. 31/2023 and expands the PMSE framework to cover more business models.

The Trade Ministry said the revision focuses on five areas.

These include improving the visibility of domestic products, helping merchants obtain legal business status, increasing transparency in platform partnership, strengthening consumer protection, and tightening digital technology governance.

The regulation requires merchants selling on platforms to obtain business licenses, with a transition period for compliance.

Platforms must also disclose fees and promotion policies, provide complaint and dispute mechanisms.

The rule also cover the use of AI in product promotion and marketing, and protect users from unfair trade practices.

The revised rule adds two PMSE business models, ride-hailing and online travel agents, or OTAs. For ride-hailing apps, the rule covers goods transactions facilitated through in-app commerce features, not transportation services.

The 2023 rule being replaced had already expanded PMSE oversight beyond marketplaces to social commerce and barred such services from facilitating payment transactions on their own systems.
