Indian startup Anthropic Software sues Anthropic over brand confusion

Indian startup Anthropic Software Private Limited, based in Belagavi, has filed a legal case against US-based AI company Anthropic PBC over alleged passing off and brand confusion in India.

The Indian company, founded in 2017, develops digital platforms for education and government sectors, mainly serving rural and underserved regions.

The Belagavi court has acknowledged the urgency of the dispute and scheduled a hearing for February 16, 2026, after allowing the case to proceed without mediation.

Anthropic Software claims its online visibility has been displaced, with search platforms prioritizing the US company’s name, causing confusion among users and stakeholders.

The Indian firm also asserts that it has operated under the name “Anthropic” since 2017 and that the name has acquired distinctive meaning in India through its continuous use and collaborations.

The company seeks a permanent injunction, damages, and the withdrawal of the US firm’s services in India.

🧠 Food for thought

Implications, context, and why it matters.

The Indian firm runs products, not a shell company

  • Anthropic Software Private Ltd. started in 2017. It builds digital platforms for education and government, with a focus on rural and underserved areas.
  • Its patented lineup includes an AI-enabled education ERP (enterprise resource planning) system, a competitive examination ecosystem, a Wi-Fi monetisation platform, and a driving safety solution 1.
  • The company says Google Search and other search and AI-based platforms now rank the US entity above it. Google invests in Anthropic PBC, which the Indian firm says worsens confusion for customers and stakeholders 1.
  • The case comes after US-based Anthropic expanded in India. It announced an India office last October and named former Microsoft India managing director Irina Ghose to run local operations 2.

Online discoverability now shapes global tech expansion

  • The dispute captures a wider problem in fast-growing markets like India. Local firms can get buried online when well-funded global AI companies move in 2.
  • The suit argues that even with years of brand equity, a company can become harder to find when a same-named entrant takes over search rankings 1.
  • Anthropic Software Private Ltd. wants a permanent injunction, damages, and a halt to the US firm’s services in India.
  • Analysts have warned that AI-driven automation, including from US-based Anthropic, could shake up India’s IT services industry. This case stays focused on brand identity and online visibility, not that automation risk 3.
