India gov’t demands Amazon, Flipkart financials

The Competition Commission of India (CCI) has demanded financial statements from Amazon and Flipkart as part of a four-year antitrust case, according to two people familiar with the matter.

The CCI’s investigation is backed by findings from India’s Director General of Investigation scrutinizing claims of anti-competitive practices, including providing preferential treatment to specific sellers, exclusive product launches, and aggressive discounting strategies that could negatively impact small retailers both on and off the platforms.

Under the revised competition law enacted in 2023, the CCI can impose fines of up to 10% of a company’s global turnover for engagement in anti-competitive conduct.

In light of the Director General’s findings, Amazon and Flipkart have expressed concerns about potential disclosure of sensitive information within the reports. The companies have asked the CCI to retract the current report and issue a new version, a request mentioned in previous Apple-related cases.
