US House weighs penalties on AI model copying by Chinese firms

House Republicans have proposed a bill that would direct the government to identify entities in China and Russia accused of using improper query-and-copy methods to extract results from US AI models.

The bill targets efforts to use those outputs to build rival systems.

The measure, called the Deterring American AI Model Theft Act, is set for review by the House Foreign Affairs Committee next week and could prompt Commerce Department blacklisting or presidential sanctions under a 1977 law.

Potential targets include Chinese AI labs DeepSeek, Moonshot, and MiniMax.

OpenAI has alleged DeepSeek used ChatGPT results to create a knock-off model, and Google and Anthropic have published reports citing similar unauthorized techniques.

A separate House China committee report also urges the Commerce Department to review those firms for entity list action and recommends Justice Department referrals.

🧠 Food for thought

Implications, context, and why it matters.

This AI bill is one piece of a broader set of bills aimed at China

  • Sponsor representative Bill Huizenga also backs the Chip Security Act. It would require advanced chipmakers to add security features that spot and block smuggling to unauthorized countries or end users. The bill cleared the House Foreign Affairs Committee with unanimous support 1.
  • Co-sponsor representative John Moolenaar proposed the bipartisan Guaranteeing Access and Innovation for National AI (GAIN AI) Act. It would put US firms first for access to advanced AI chips over companies from arms-embargoed countries 2.
  • Moolenaar also put forward the Advanced AI Security Readiness Act with other bipartisan members of the House Select Committee on China. The panel focuses on US-China competition 3.

The billion-dollar question on tech controls and China’s tech industry

  • These moves could speed up Chinese tech self-reliance, as happened after earlier US export controls 4.
  • After US export controls hit Huawei, the Chinese telecoms and technology company said it swapped out more than 13,000 components. It also built its own operating system. US firms may have lost more than US$33 billion in Huawei sales from 2021 to 2024 4.
  • Other analysis argues the limits still protect a US edge. The best US AI chips are about five times more powerful than Huawei’s top chips 5.
  • That gap could grow to 17 times by 2027 5.
