Google faces EU complaint over AI search summaries

Google has been accused of misusing its market power in online search through its AI Overviews feature.

Independent publishers filed a complaint with the European Commission, claiming the AI-generated summaries use their content.

They say the summaries appear at the top of search results and lead to traffic and revenue losses.

The June 30 complaint also says publishers can’t opt out of AI training or summaries without losing visibility in search results.

The Independent Publishers Alliance submitted the complaint with backing from the Movement for an Open Web and Foxglove Legal.

They seek interim measures to protect competition and ensure access to independent journalism.

🧠 Food for thought

1️⃣ EU’s consistent pattern of regulating digital gatekeepers continues

The complaint against Google’s AI Overviews follows a well-established pattern of EU antitrust enforcement against the company spanning over a decade.

In 2017, the European Commission imposed a record €2.42 billion fine on Google for favoring its own comparison shopping service in search results, demonstrating the EU’s willingness to take strong action against perceived market abuses 1.

This regulatory approach reflects a fundamental difference in philosophy compared to the US, with the EU prioritizing market structure and competition over consumer welfare standards, leading to more aggressive enforcement actions 2.

The current complaint mirrors earlier cases by focusing on Google’s alleged leveraging of its dominant market position in search (approximately 90% in Europe) to extend control into new areas, potentially disadvantaging competitors 3.

Publishers’ inability to opt out of AI Overviews without losing search visibility echoes previous complaints about Google’s practices, where companies like Foundem alleged their business was harmed by Google’s search algorithms and placement practices 4.

2️⃣ AI Overviews accelerate the publisher traffic crisis with measurable impacts

Recent data shows AI Overviews have significantly reduced publisher traffic, with click-through rates declining by up to 43.9% on desktop and 32.5% on mobile when content appears in these summaries 5.
