Florida opens OpenAI probe over safety, security risks

Florida has opened an investigation into OpenAI and ChatGPT over safety and national security concern.

Official said the probe will examine risks tied to foreign access, child safety, and alleged criminal misuse of ChatGPT.

The move adds to wider scrutiny of OpenAI after California Attorney General Rob Bonta and Delaware Attorney General Kathy Jennings sent the company a letter in September 2025 about reports of how its products interact with children.

🧠 Food for thought

Implications, context, and why it matters.

The probe comes after OpenAI’s safety plan and a stalled state AI bill

  • Florida announced the investigation one day after OpenAI released its “Child Safety Blueprint.” OpenAI said it built the framework with the National Center for Missing and Exploited Children, a US nonprofit focused on child protection, plus the Attorney General Alliance’s AI Task Force, a multistate group reviewing AI policy 1.
  • The state action follows an unsuccessful push for a broader “AI Bill of Rights.” Uthmeier has since urged Florida lawmakers to give his office more authority over tech companies 1.

Florida’s probe shifts legal focus from moderation to AI tool responsibility

  • The investigation shifts attention away from the content moderation model used for social media platforms. It instead tests whether AI developers can be held responsible for how people use their tools 2.
  • Filtering explicit material is one challenge. Figuring out a user’s intent is much harder 3.
  • The move raises the odds of a state-by-state set of AI rules after the broader Florida AI bill stalled. That could create compliance pressure similar to state data privacy laws 1.
  • Developers may respond by tightening system limits early to lower legal exposure. That could curb new features across the AI sector, not only at OpenAI.
