Ex-Celsius CEO seeks 366-day term in fraud case

Former Celsius CEO Alex Mashinsky has asked a US court to limit his prison sentence to 366 days.

This request comes as federal prosecutors advocate for a 20-year term after Mashinsky pleaded guilty to one count of commodities fraud and one count of manipulating the price of the CEL token.

His lawyers argued the government’s 20-year proposal is excessive, especially given that Mashinsky is a first-time offender.

They claimed prosecutors exaggerated his role and pointed out he has not admitted guilt to all charges.

At 59 years old, Mashinsky could face a lengthy prison term that would result in his release at over 79 if the government’s recommendation is granted.

Mashinsky faced seven counts in total, which included fraud and market manipulation.

🧠 Food for thought

1️⃣ Cryptocurrency fraud sentencing shows wide variance based on case specifics

Mashinsky’s lawyers’ request for a 366-day sentence contrasts sharply with federal prosecutors’ 20-year recommendation, highlighting the wide range of sentencing outcomes in cryptocurrency-related fraud cases.

Previous cryptocurrency fraud cases show significant variation: Joseph Kim received 15 months for misappropriating $1.1 million in Bitcoin and Litecoin in 2018 1, while Jacob Burrell Campos was sentenced to two years for operating an unlicensed money transmitting business involving hundreds of thousands in Bitcoin 2.

At the extreme end, Ross Ulbricht received a life sentence for creating the Silk Road marketplace, which facilitated illegal drug sales using Bitcoin 3.

The variance reflects the evolving legal framework surrounding digital assets, with prosecutors and judges weighing factors including the scale of losses, number of victims, and perceived intent of the defendant.

Mashinsky’s case is particularly notable as it involves one of the largest cryptocurrency lending platforms, with Celsius owing users approximately $4.7 billion at the time of its collapse 4.

2️⃣ Celsius collapse represents one of the largest crypto lending failures with lasting market impact

The Celsius bankruptcy marked a dramatic reversal for a platform that once managed $25 billion in assets before collapsing to just $167 million in cash during the 2022 market downturn 4.
