EU plans pause to AI rules, data privacy overhaul

The European Commission is expected to propose changes to the EU’s digital regulations next week, including a one-year pause on parts of its AI law and revisions to data protection rules.

The proposals include narrowing the definition of personal data and allowing companies to process such data for AI training under “legitimate interest.”

Privacy advocates and 127 organizations warned that these changes could weaken digital rights.

The commission also plans to remove website cookie consent banners.

Proposed delays would push high-risk AI rules to 2027.

The updates still need approval from the European Parliament and member states, and some lawmakers have already voiced opposition.

🧠 Food for thought

Implications, context, and why it matters.

EU may shift cookies from consent to ‘legitimate interest’

  • Lawmakers would move cookie policy from the ePrivacy Directive (the EU’s rulebook for privacy in electronic communications) into the General Data Protection Regulation (GDPR) 1. Under GDPR, companies can cite “legitimate interest” for data use if a stated business need does not override user rights 1. That would replace explicit opt-in for many cookies.
  • Tracking would become the default, with users objecting after the fact 2.
  • The draft narrows what counts as personal data, which could enable more tracking and profiling 3. It could exclude pseudonymous identifiers such as ad IDs and cookies, which are signals that don’t directly name a person but can be tied back over time 3.
  • Media companies get an explicit carve-out from automatic browser preference enforcement, a system of browser-level privacy signals that state a user’s choices 2. The carve-out protects ad revenue, so publishers can keep requiring consent for personalized ads 2.

Privacy-tech may pivot with consent and browser signals

  • If consent banners fade, vendors can pitch privacy-preserving analytics and contextual advertising. They can also offer next‑gen consent tools tuned to the new baseline for publishers and ecommerce platforms, plus Software-as-a-Service (SaaS).
  • Teams and investors should track the timeline, with a formal proposal on November 19 and earliest enforcement in 2027, then phase launch plans for sectors that depend on cookies and consent platforms 2.
  • Firms that use consent managers today may switch to documenting “legitimate interest” processing instead, which lifts demand for compliance automation and documentation software 1.
