OpenAI asks judge to dismiss trade secrets suit from Musk’s xAI

OpenAI has asked a US federal judge to dismiss a lawsuit from Elon Musk’s AI startup xAI that accuses OpenAI of poaching staff and stealing trade secrets.

OpenAI denied xAI’s claims, calling them false and unsubstantiated in its court filing on October 2.

The suit, filed last week in San Francisco, alleges OpenAI hired away former xAI employees to access trade secrets related to xAI’s chatbot Grok.

OpenAI argued in its filing that employees are free to choose where they work, and that hiring competitors’ staff is not unlawful.

The legal dispute is part of broader tensions between Musk and OpenAI, who are rivals in the AI sector.

Musk, who co-founded OpenAI, is also suing the company over its for-profit status, while xAI has filed a separate lawsuit against Apple, alleging Apple and OpenAI conspired to suppress competitors.

Both Apple and OpenAI have denied those allegations and sought dismissals in court.
