Dutch court confirms Apple abused dominance over dating apps

A Dutch court has upheld a 2021 decision by the country’s consumer watchdog, which found that Apple abused its dominant position by imposing restrictive conditions on dating app providers in its App Store.

The Rotterdam District Court confirmed that the Dutch Authority for Consumers and Markets (ACM) acted correctly in penalizing Apple for non-compliance.

The ACM determined that dating app providers were unfairly required to use Apple’s payment system. They were also barred from referencing external payment options and faced a commission of up to 30%.

Apple has announced its intention to appeal the decision.

A company spokesperson said, “This ruling undermines the technology and tools we’ve created to benefit developers and protect users’ privacy and security.”

In 2021, the ACM fined Apple 50 million euros (US$58 million) for failing to implement changes it had ordered to address practices that violated European Union antitrust laws.
