Canada court blocks TikTok shutdown order during security review
Canada’s federal court has overturned a government order to shut down TikTok’s operations, allowing the app to continue while the case is reviewed.
The order, issued in November 2024 by Canada’s industry ministry, cited national security concerns but did not block user access or content creation.
TikTok, with over 14 million monthly users in Canada, appealed the decision.
Judge Russel Zinn sent the case back to Industry Minister Melanie Joly for further review without providing reasons. The industry ministry has not commented.
TikTok welcomed the ruling and expressed interest in cooperating with authorities. Canada’s scrutiny of TikTok has grown amid concerns about China using the platform for data collection or influence.

🧠 Food for thought
Implications, context, and why it matters.
The legal path forward for TikTok remains unclear
- Uncertainty has been created by the court’s decision to send the matter back to Industry Minister Melanie Joly, since the legal steps and standards for her reconsideration have not been set out.
- The November 2024 order requiring TikTok Technology Canada, Inc. to wind up its Canadian business was made by the Governor-in-Council (the federal cabinet acting through the Governor General) under the Investment Canada Act (a law that allows Ottawa to review and restrict certain foreign investments on national security grounds) 1.
- Clarity is still needed on which routes may be taken next by the federal government, including a new dissolution order with changed terms or an appeal of the federal court’s decision.
- Longer-term operating exposure for TikTok and its more than 14 million monthly users in Canada is still hard to gauge, since no deadline has been set for the review.
Adtech firms can capitalize on the regulatory uncertainty
- Adtech operators and investors can keep selling TikTok inventory while it remains available, plus help advertisers prepare backup plans if the platform’s status shifts again.
- Many marketers expect to raise TikTok spending, since Kantar (a market research firm) ranked it #1 for capturing consumer attention 2.
- Budgets may be watched more closely amid economic uncertainty, so buyers will look for tools that cut waste and manage downside risk 3.
- Companies that offer cross-platform controls for quick budget shifts or creative automation can pitch brands worried about fast ad fatigue on TikTok while the government review continues.
