Australia sues ex-Blockchain Global director for duty violations

Australia’s corporate regulator has initiated civil proceedings against Liang (Allan) Guo, a former director of the cryptocurrency exchange firm Blockchain Global.

The Australian Securities and Investments Commission (ASIC) alleges that Guo breached multiple duties related to his role in the firm’s ACX Exchange platform.

The ACX Exchange ceased operations in December 2019, resulting in customers being unable to withdraw funds or cryptocurrencies.

ASIC’s allegations focus on Guo’s management of customer funds, statements made, and his failure to maintain proper records.

🧠 Food for thought

1️⃣ Australia’s crypto exchange failures mirror global pattern amid regulatory evolution

The ACX Exchange collapse represents part of a broader vulnerability in cryptocurrency markets that extends beyond Australia’s borders.

The cryptocurrency market has experienced numerous high-profile exchange failures globally, including FTX and Celsius in 2022, resulting in substantial investor losses similar to Blockchain Global’s reported A$58 million ($37.3 million) debt to creditors 1.

This pattern emerges despite Australia implementing relatively early regulations, requiring cryptocurrency exchanges to register with AUSTRAC since 2017 and comply with Anti-Money Laundering and Counter-Terrorism Financing regulations 1.

The timing of the ACX collapse in December 2019 falls within a critical period when regulatory frameworks worldwide were still maturing, highlighting the challenges governments face in keeping pace with rapidly evolving financial technologies.

The regulatory gap is particularly concerning given that only about 20% of cryptocurrency owners in Australia are aware of the risks associated with digital asset investments, indicating a significant knowledge disparity among the estimated 1+ million Australian crypto investors 1.

2️⃣ Cross-border enforcement challenges complicate cryptocurrency regulation

The case of Liang Guo leaving Australia despite earlier travel restrictions illustrates the persistent challenges authorities face in enforcing compliance across international boundaries.

Cryptocurrency’s borderless nature creates jurisdictional complications for regulators, with individuals potentially able to relocate while digital assets remain accessible globally—a fundamental challenge not present in traditional financial systems 1.

These enforcement difficulties are amplified in Australia’s case by the substantial cryptocurrency adoption rate, with surveys suggesting up to 20% of Australians may own digital assets 1.
