Apple tells EU it meets Digital Market Act thresholds

Apple has informed the European Commission that its Apple ad and Apple Maps services meet the thresholds set by the Digital Markets Act.

The EU Commission will now review whether to designate Apple as a gatekeeper for these services, with a decision expected within 45 working days.

If designated, Apple will have six months to comply with the act’s requirements.

The Digital Markets Act aims to regulate large digital platforms operating in the European Union.

🧠 Food for thought

Implications, context, and why it matters.

If designated, Digital Markets Act (DMA) rules could push Apple to share ad data and open system features

  • If designated, Apple’s ads business must give advertisers and publishers free access to measurement tools plus data for independent ad verification 1.
  • Apple would need to let third‑party providers plug into the same hardware plus software features through effective interoperability (the ability to connect then use the same capabilities) free of charge under Article 6(7) of the DMA 1.
  • Apple would be barred from combining personal data across services without user consent 2. That limit would curb use of App Store, Safari, plus other service data for ad targeting or mapping recommendations.
  • Google described “difficult trade‑offs” during DMA changes 3 that Apple could face when it implements cross‑product recommendations and features at a cost to user experience.

Advertising‑technology (ad‑tech) firms can use DMA‑mandated advertiser data to build cross‑platform tools

  • After designation, independent ad‑tech companies can tap the measurement tools plus verification data Apple must provide 1. That access supports unified dashboards that compare Apple’s ads with Meta Ads 4 or Alphabet’s services.
  • Analytics startups can prep for Apple measurement feeds by reviewing DMA changes already rolled out by other gatekeepers (companies designated under the DMA) 3.
  • Attribution platforms (software that determines which ads drive actions like purchases or sign‑ups) can use the required “continuous and real‑time access” to aggregated plus non‑aggregated data 1. They can build tools that measure campaign performance within the relevant DMA‑defined core platform services, subject to user consent where required.
  • Google’s emphasis on “consistent interpretation and enforcement of DMA rules across all the designated companies” 3 gives ad‑tech firms a benchmark to cite when pushing for data‑access parity across gatekeepers.
