Adani reps, US officials talk to settle bribery case: sources

Representatives of Gautam Adani, an Indian businessman, have discussed criminal charges related to an overseas bribery investigation with US officials.

Sources indicate that these talks, which have intensified recently, aim to potentially resolve the situation in the coming months.

The charges, revealed by the Biden administration shortly after Donald Trump’s election victory in November, accuse Adani and his nephew Sagar of offering US$250 million in bribes to secure solar-power contracts with Indian regional officials.

Both Adani and his conglomerate, the Adani Group, have denied these allegations.

The US Justice Department and the White House have not commented on the ongoing discussions.

🧠 Food for thought

1️⃣ FCPA settlements reveal pattern of negotiated resolutions over prosecution

Adani’s approach follows a well-established pattern among companies and executives facing Foreign Corrupt Practices Act (FCPA) charges, where negotiated settlements are far more common than full prosecutions.

Major corporations like Siemens, Halliburton, and Alstom have previously resolved FCPA violations through settlements ranging from $579 million to $1.6 billion, suggesting a legal framework where financial penalties are preferred to lengthy trials 1.

These precedents demonstrate that even in cases involving substantial alleged bribes—like the $250 million Adani is accused of promising—there are established pathways to resolution that avoid criminal conviction while still imposing financial consequences.

The Justice Department has historically shown willingness to negotiate in foreign bribery cases, particularly when companies can demonstrate cooperation and remediation, though the scale of Adani’s alleged violations would place it among the more significant FCPA cases.

2️⃣ Corporate lobbying leverages shifting US-India strategic priorities

Adani’s lobbying strategy appears calibrated to the evolving US-India relationship, where bilateral ties have strengthened significantly in recent years despite occasional tensions.

The Trump administration previously emphasized expanding defense cooperation with India and countering China’s influence in the Indo-Pacific region, priorities that continue to shape US strategic thinking 2.

By engaging BGR Group, which represents India in trade talks with the Trump administration, Adani is leveraging established diplomatic channels within a relationship that both countries have described as a “Major Defense Partnership” 3.
