“The Delhi High Court has rejected PhonePe’s plea to issue an injunction order against BharatPe for using ‘Pe’ in its name,” reported Entrackr.
Details:
- According to the judge who handled the case, there was insufficient evidence to conclude that people associate the suffix “Pe” to PhonePe, a fintech firm backed by Indian ecommerce giant Flipkart.
- The court ruling also dismissed the claim that fintech startup BharatPe’s logo color and font are similar to PhonePe’s. The judge further said that a trademark cannot be dissected and exclusively claimed.
Context:
- In 2019, PhonePe had filed a court petition seeking a restraining order against BharatPe for alleged trademark infringement.
- In February, BharatPe was close to hitting unicorn status after it raised US$108 million in fresh funding.
